Abstract:
This dataset shows the 1,000 foot radius of entities identified in WAC 314-55 and PCC 18A.12, as shown below. The radius is measured from the parcel line of each property identified as a sensitive use. The dataset is intended to be used when reviewing marijuana producer, processor, and retail license requests from WSLCB or establishing a licensed marijuana business in unincorporated Pierce County. Please be advised that there are limitations to this dataset and it may not be entirely comprehensive. The reviewer should also check the area 1,000 feet around the property line of the proposed location for any unmapped entities. The dataset may also not be entirely correct, as it uses outside data sources to find entities. The reviewer should also check the source of each radius that touches a proposed location to confirm if the identified entity exists and is within 1,000 feet of the proposed location.The dataset is based on the following regulations and definitions:WAC 314-55-050 (10) states:The board shall not issue a new marijuana license if the proposed licensed business is within one thousand feet of the perimeter of the grounds of any of the following entities. The distance shall be measured as the shortest straight line distance from the property line of the proposed building/business location to the property line of the entities listed below:(a) Elementary or secondary school;(b) Playground;(c) Recreation center or facility;(d) Child care center;(e) Public park;(f) Public transit center;(g) Library; or(h) Any game arcade (where admission is not restricted to persons age twenty-one or older).WAC 314-55-010 defines the following uses:(6) "Elementary school" means a school for early education that provides the first four to eight years of basic education and recognized by the Washington state superintendent of public instruction.(9) "Game arcade" means an entertainment venue featuring primarily video games, simulators, and/or other amusement devices where persons under twenty-one years of age are not restricted.(11) "Library" means an organized collection of resources made accessible to the public for reference or borrowing supported with money derived from taxation.(20) "Playground" means a public outdoor recreation area for children, usually equipped with swings, slides, and other playground equipment, owned and/or managed by a city, county, state, or federal government.(21) "Public park" means an area of land for the enjoyment of the public, having facilities for rest and/or recreation, such as a baseball diamond or basketball court, owned and/or managed by a city, county, state, federal government, or metropolitan park district. Public park does not include trails.(22) "Public transit center" means a facility located outside of the public right of way that is owned and managed by a transit agency or city, county, state, or federal government for the express purpose of staging people and vehicles where several bus or other transit routes converge. They serve as efficient hubs to allow bus riders from various locations to assemble at a central point to take advantage of express trips or other route to route transfers.(23) "Recreation center or facility" means a supervised center that provides a broad range of activities and events intended primarily for use by persons under twenty-one years of age, owned and/or managed by a charitable nonprofit organization, city, county, state, or federal government.(25) "Secondary school" means a high and/or middle school: A school for students who have completed their primary education, usually attended by children in grades seven to twelve and recognized by the Washington state superintendent of public instruction.PCC 18A.12.020 B adds the following entities: B. Marijuana-licensed business shall not be permitted within 1,000 feet of the perimeter grounds of the following entities:…9. Any parcel containing a marijuana retail outlet licensed by the Washington State Liquor Control Board; or10. Religious assembly.Ordinance 2015-27s adds the following entity and is effective July 1, 2016:11. Scenic and recreational highways as designated at RCW 47.39.020Pierce County shall rely upon the definitions set forth in Chapter 314-55 of the Washington Administrative Code when identifying the entities listed above.
Purpose:
This dataset is to be used when reviewing the proposed location of new State-licensed recreational marijuana businesses. The area shown is the 1,000 foot radius from the parcel lines of entities as identified and defined in WAC 314-55 and PCC 18A.12. Recreational marijuana-related businesses are not allowed to locate on properties that are within or touch the boundary of the area shown.
